Facebook may launch self-destructing message app

2 hrs.

Sometimes you really need a message to self-destruct after its intended?recipient?has seen it ? just ask Ethan Hunt ... or anyone who's ever been embarrassed by a love note or racy photo. Facebook may be at work on an app that makes your "Mission Impossible" fantasies come true, according to a report.

All Things D's?Mike Isaac writes that?"sources familiar with the matter" claim that the social network is currently testing an app similar to Snapchat???a service that?allows users to send photos, videos or messages which will self-destruct up to 10 seconds after being viewed.

Like Facebook's Messenger and Camera, this new app will supposedly be a standalone download, separate from the main Facebook app. (As Isaac points out, this means that Facebook will wind up with five individual apps, if you're counting Instagram. Not that that's any match for Amazon, with over 10, and Google, with over 20, on the iOS platform alone.)

Based on what Isaac's sources reveal, Facebook's app will function almost exactly like Snapchat. "After a user opens the new app, they?re presented with a list of current message threads between them and their friends," Isaac explains. "Hold your finger down on one of the threads, and a timer comes up to ask how long the message should be viewable. From there, you?re able to send the message ? which, just like on Snapchat, will only be viewable for a fixed period of time."

Snapchat does have a feature that alerts users if a message?recipient?took a screenshot before the message disappeared. No word as to whether Facebook will incorporate something similar. Without these kinds of precautions, users will have a false sense of security, like some people feel with apps such as Snapchat. But whatever the technological advancements, there will generally remain ways to copy or otherwise capture those sensitive correspondences. After all, anyone can take a photo of a screen.

Edmonton MP charged with refusing breath sample won't get police ...

EDMONTON ? An Edmonton MP won?t be getting access to all police radio communications?

Here at Maclean's, we appreciate the written word. And we appreciate you, the reader. We are always looking for ways to create a better user experience for you and wanted to try out a new functionality that provides you with a reading experience in which the words and fonts take centre stage. We believe you'll appreciate the clean, white layout as you read our feature articles. But we don't want to force it on you and it's completely optional. Click "View in Clean Reading Mode" on any article if you want to try it out. Once there, you can click "Go back to regular view" at the top or bottom of the article to return to the regular layout.

EDMONTON ? An Edmonton MP won?t be getting access to all police radio communications on the night he was arrested for refusing to provide a breath sample.

Judge Larry Anderson ruled there was no evidence to suggest that the large volume of calls that night had anything to do with the case against Peter Goldring.

Goldring had been seeking a list of all radio calls made the night he was arrested as well as recordings or transcripts of them. Anderson agreed that information could be relevant, but ruled there was no reason to believe it was.

?The testimony of the officer listening to the communication was that, with one exception, none of the 200-plus communications have anything to do with this investigation,? said Anderson.

?It has been submitted by the defence that the officer made a mistake. But for me to find that, I would have to speculate.?

However, the Crown has agreed to look for other police records that Goldring has requested. Defence lawyer Dino Bottos said the Crown will search for reports from the police shift supervisor that night to his superior officer as well as notes transmitted in the internal police computer system.

The police shift supervisor has acknowledged the arrest was handled differently from others in that within an hour he had phoned his supervisors to give them a heads-up that a high-profile person had been charged.

The 15-year MP for Edmonton-East is to go on trial in January on a charge of refusing to provide a breathalyzer sample after he was stopped leaving the parking lot of a north end sports bar last December.

Goldring was re-elected most recently as a Conservative but has sat as an Independent since shortly after his arrest.

He has suggested his defence will include the assertion that police unfairly targeted him and his vehicle to be pulled over during a Checkstop crackdown.

Goldring has long been a critic of random breathalyzers and Checkstops. He says he supports cracking down on drinking and driving, but he believes that random checks with no reasonable grounds for search infringe on civil liberties.

Officers have told the court Goldring was acting in a belligerent manner and tried to negotiate his way out of stop.

None of those allegations have been proven at trial and Goldring?s lawyer says he plans to file a Charter of Rights challenge to the arrest on Friday.

His trial has been scheduled for Jan. 17.

U.S. defense chief orders Patriot missiles to Turkey

INCIRLIK AIR BASE, Turkey (Reuters) - U.S. Defense Secretary Leon Panetta signed an order on Friday to send two Patriot missile batteries to Turkey with 400 American personnel to operate them, in a move by NATO members to bolster Turkey's defenses against the threat of Syrian missiles.

The order was signed shortly before Panetta arrived on an unannounced visit to Turkey to meet American troops stationed at the Incirlik Air Base, the last stop on a week-long trip that took him to Afghanistan and Kuwait.

"The purpose of this deployment is to signal very strongly that the United States, working closely with our NATO allies, is going to support the defense of Turkey, especially with potential threats emanating from Syria," spokesman George Little said.

NATO-member Turkey has repeatedly scrambled jets along the countries' joint frontier and responded in kind when shells from the Syrian conflict came down inside its borders, fanning fears that the civil war could spread to destabilize the region.

The widely expected U.S. move follows similar steps by Germany and the Netherlands, which also said they will send two Patriot batteries. The three countries are the only NATO nations with the most modern type of Patriots.

Little declined to say where the U.S. batteries would be located and said the systems would be deployed to Turkey for an unspecified amount of time.

"We expect them to be deployed in the coming weeks," Little said.

NATO approved Turkey's request for air defense batteries on December 4, in a move meant to calm its fears of coming under missile attack, possibly with chemical weapons, from Syria.

The Patriot system is designed to intercept aircraft or missiles. NATO says the measure is purely defensive, but Russia, Syria and Iran have criticized the decision, saying it increases regional instability.

Report: Jackie Chan suggests Hong Kong curb rights

HONG KONG (AP) ? Jackie Chan suggests in a recent interview that protests should be restricted in the freewheeling Chinese city of Hong Kong.

The action star lamented that Hong Kong has become a city of protests, where people "scold China, scold the leaders, scold anything, protest against anything.

"There should be regulations on what can and cannot be protested," Chan told the Southern People Weekly, which published his comments Wednesday. He didn't say what kinds of protests he thought should be restricted.

The star of movies such as "Rush Hour" and "Rumble in the Bronx" triggered a backlash three years ago with similar comments on the need to restrict freedom in his hometown.

A former British colony, Hong Kong was returned to China in 1997 and is now a semiautonomous region. Residents are fiercely proud of the Western-style civil liberties they enjoy that are not seen on the mainland, including the freedom to demonstrate.

The city has been the scene lately of a rising number of protests by people upset with their Beijing-backed leader, Leung Chun-ying, a lack of full democracy and worries about Beijing's growing influence on the city.

Tens of thousands of people took to the streets in July to protest after Leung took office.

In 2009, Chan sparked outrage among lawmakers in Hong Kong when said he said, "I'm not sure if it's good to have freedom or not." He also said he was "beginning to feel that we Chinese need to be controlled."

A representative for Chan did not respond to request for comment.

Assess the Amount of Care Needed - Pittsburgh In Home Senior Care

It is wonderful news to find out that your loved one is being discharged from the hospital and will be coming home soon. As a family caregiver you know there may be extra work and time involved in bringing your loved one home, but how do you go about assessing the actual amount of care needed and how much time it will take?

Pittsburgh ? Central Home CareWe have assembled a checklist below to help family caregivers determine how much care they might need to provide. As you go through the list, make a note of how much time it will take to accomplish the various tasks. If you are considering employing a?home health care agency to support you and your loved one, then you will need to factor in a small amount of time to manage those services as well.

1. Patient Restrictions and Activities:?Will your family member be able take a bath or shower, lift heavy items or walk up stairs? Can you leave him or her alone? Are you prepared to help your loved one with exercise instructions as well as train other family members to help?

2. Equipment and Supplies:?Make a list of items you will have to shop for and whether you will need to provide assistance or receive training in using these items. They might include a hospital bed, shower chair, oxygen supply, disposable gloves or special skin care items.

3. Home Safety:?What changes are needed to help make your loved one?s home safe? Do you need to move out items that might cause a fall such as area rugs or electrical cords? Do you need to make room for a hospital bed and other large equipment? Is there a prominent place to post important information such as medication schedules and emergency contact information for you and other involved caregivers to reference? Use this?Home Safety Checklist?to ensure your senior returns to the safest environment possible.

4. Health Care Tasks:?What tasks will you have to perform and will you need any special training to accomplish them? If you can, plan on receiving the training, such as wound care or taking and recording vital signs, while your family member is still in the hospital.

5. Special Diets:?Will you need to purchase and prepare any special foods? For example, your loved one may be on a liquid diet for some period of time.

6. Medication Management:?Will you be able to monitor your family member to ensure he or she takes the correct medication at the right time in the right amount? Is there a chart that explains all the medications and when and how they should be taken? For example, are medications taken with meals or during certain times of the day? Are you and other family members aware of any side effects from the medications? Will you have to go the pharmacy to pick up medications? Watch these?medical management videos?for more tips on ensuring your loved one?s safety or use this?medication management checklist?to help you track your family member?s medications.

7. Follow-Up Care:?Will you or another family member arrange for follow-up care and appointments? How often and where will they need to take place?

8. Medical Expenses:?As the primary caregiver you may have to manage your family member?s medical expenses including correspondence with the hospital, Medicare and insurance companies.

9. Other Financial Issues:?Are you prepared to?manage your loved one?s finances, deposit retirement payments, balance his or her checking account and pay bills? There may be additional financial issues including taxes and home maintenance and repairs as well.

In addition to managing your loved one?s care, be sure to factor in time for yourself. It is important for family caregivers to take care of themselves while taking care of others. Remember that you don?t have to do everything on your own; hiring professional?in-home caregiver services?for even just a few hours per week can give you the time you need to focus on your own needs.

Heinicke, Breitenstein lead AP FCS All-Americans

NEW YORK (AP) ? Payton Award finalists Taylor Heinicke, the record-setting quarterback from Old Dominion, and running backs Eric Breitenstein from Wofford and Miguel Maysonet from Stony Brook were selected to The Associated Press FCS All-America team released Wednesday.

Heinicke had the most prolific passing season in the history of what used to be called Division I-AA football. The sophomore from Georgia passed for 5,076 yards and had 5,546 yards of total offense, breaking records set by the late Steve McNair when he was at Alcorn State in 1994.

"What Taylor did this year from an individual standpoint is nothing short of incredible," ODU coach Bobby Wilder said Wednesday.

"We build our system around our quarterback and what we feel like are his strengths. To run an offense that suits their needs. As (Heinicke) has gotten comfortable in our system, we've become more of a throwing team because of his comfort level."

The Walter Payton Award goes to the top player in FCS and will be handed out Dec. 17.

Directing the Monarchs' fast-paced spread, Heinicke also set FCS records for completions (398) and total plays (705). And Heinicke ran for 470 yards and 11 touchdowns.

"He understands our philosophy is to find a way to move the chains," Wilder said. "If you need to run the ball, you run it to get a critical first down and those first downs lead to touchdowns. Protect the ball and find a way to move the chains."

Heinicke did just that in September against New Hampshire when he passed for a Division I record 730 yards in a 64-61 victory. He threw 79 passes in that game without an interception.

Old Dominion finished 11-2 record, losing last week to Georgia Southern, 49-35, in the quarterfinals of the playoffs.

Breitenstein made his second straight appearance as a first-team All-American. The 230-pound senior fullback ran for 2,035 yards and 19 touchdowns this season.

Maysonet ran for 1,964 and 21 touchdowns for the Seawolves.

Murray State quarterback Casey Brockman was picked to the second-team. Colgate quarterback Gavin McCarney made the third team.

Eastern Illinois' Erik Lora and Elon's Aaron Mellette, ranked 1-2 in the nation in catches and yards receiving, were the receivers and Harvard's Kyle Juszczyk was the tight end.

A couple of guys who will be playing in this weekend's FCS semifinals highlight the offensive line.

Bill Turner and North Dakota State host Georgia Southern on Friday night and Will Post and Eastern Washington host Sam Houston State on Saturday.

The other linemen were Earl Watford from James Madison, Mike Sellers from The Citadel and Roger Gaines from Tennessee State.

The defense is led by Georgia Southern's 300-pound defensive tackle Brent Russell and Georgetown linebacker Robert McCabe, who leads the nation with 14.45 tackles per game.

Brandon Thurmond of Arkansas-Pine Bluff, the nation's leader with 17? sacks, joined Russell on the line along with Colton Underwood of Illinois State.

Montana State placed two players on the defense. End Caleb Schreibeis leads FCS with eight forced fumbles and linebacker Cody Owens was the Big Sky defensive player of the year.

New Hampshire linebacker Matt Evans, who was a second-team All-American last year, made the first team this year.

Defensive back Marcus Williams of North Dakota State joined Breitenstein as a two-time All-American and became the only defensive player to repeat this season.

North Dakota State and Montana State were the only teams to place two players on the first team.

The other defensive backs were Darnell Taylor of Sam Houston State, Jaquiski Tartt of Samford and Cooper Taylor of Richmond.

Walter Powell of Murray State was the all-purpose player. He had 1,213 yards receiving and more than 900 yards returning kicks and punts.

Patrick Murray of Fordham was the kicker and Sam Martin of Appalachian State was the punter.

We just wanted to let you know that all?s well so far on our cruise. We arrived in San Francisco relatively early but it ended up being a good thing because they said the lines getting on the ship later in the day were awful. So we lucked out. We explored the ship, had a little lunch and took a little nap before we got underway. San Francisco was clear and warm ? about 80 degrees ? so sailing out of the Bay was gorgeous. Passing by so closely to Alcatraz we could see all the buildings and then sailing under the Golden Gate Bridge was quite exciting. We took LOTS of pictures, hoping to get a few good ones. There was a couple who had just gotten married, so they were all around the decks taking advantage of the beautiful photo ops.

Since then, when we travel, I started writing Travelogues and sending them home to family and friends because everyone wanted to know what we were doing and seeing on our trips. We took a 14 day cruise from San Francisco to Alaska visiting many places that neither of us had ever been to before. The 14 days went by far too fast for both of us.Monday we were in Monterey. The ship was anchored out in Monterey Bay ? local regulations because of the marine preserve and all, we could not drop anchor nor could they sound the horn when we left ? so it was a little unexciting. We visited family during the day and enjoyed our time with them. It was a great day ? but as always ? too short.

You offer a playful response and a stiff smile, but as Greg?s laughter echoes through your brain, you can feel your insides churn with embarrassment. You know that the person with the challenged convertible roof was you. Not only that, but as a result of that faulty roof, your entire interior is now smelly, moist, and more reminiscent of a bed of moss than car upholstery.

There's so much data that we're running out of words to describe it

1 day

The world is producing and storing data at such a rate that the day isn't far off when we will literally no longer have a proper way of describing it. From mega to giga to tera to peta, the prefixes we use to describe piles of bytes are starting to run out.

It seems like every year we end up having to change the go-to word meaning "lots of data." It wasn't long ago that a gigabyte was an enormous amount of space to have on your computer, and terabytes were strictly for scientists and companies like IBM.

Nowadays, a terabyte (or several) is standard?for personal use, and petabytes are what we talk about when we have to make a point about the data stored by Facebook and Google. And soon those terms won't seem so big, either, as we move on to exabytes.

The problem is?that after exabytes, we have zettabytes, and then yottabytes, and then ? nothing. Zetta and yotta (and their submultiple counterparts, zepto and yocto) are the most extreme numerical prefixes we have. They were made official?in 1991 at the 19th General Conference of Weights and Measures. Evidently?they didn't foresee the need to describe anything with a greater multiple than yotta, or 1,000,000,000,000,000,000,000,000.

Indeed, yotta-anything sounds like it should be enough. The diameter of the observable universe would be approximately just 880 yottameters, points out Jessica Leber at MIT's Technology Review ? meaning if there were a bigger prefix?than yotta, the entire universe would fit inside one of them.

But the International Bureau of Weights and Measures neglected to consider the needs created by the?exponential increase in data storage. Individual hard drives hold terabytes; a rack of servers might have a few hundred drives, and a data?center could have hundreds or thousands of racks.

We're already well into petabyte territory ? in fact,?Facebook claimed to store around 100 petabytes earlier this year. Add in all the datacenters belonging to Google, Flickr, Apple, and everything else, and exabytes are very much in play.

And that's just the data we've stored; We also have to consider the enormous amount of data being transferred every day on YouTube, Netflix, DropBox, and others involved with "Big Data."

Admittedly, you can always resort to one of the many actual numbers that stretch far beyond the prefix scale: A yottabyte is a septillion bytes, so if you want more, just say octillion, or nonillion, or quattuordecillion. These "dictionary numbers" can be created endlessly by combining Latin prefixes. But giga,?tera, and whatever comes after yotta have to be decided on by the Bureau.

What are they likely to choose, should they convene for a 20th General Conference?

The prefixes so far have been linguistically-neutral (i.e. able to be pronounced by speakers of many languages) variants on Greek and Latin prefixes denoting various sizes and?numbers. Peta, for instance, which indicates 10^15 or?five sets of three zeroes, comes from the Greek word for five:??????, or pente. Zetta and yotta were based loosely?on the Latin "septem" and "octem" respectively.

Speculators on the web suggest the next prefix will be "xenna," after the Greek "ennea" for nine, though they could also go with "nonna," "enna," or any other variation suggestive of the Greek or Latin. After that, even the speculators aren't really sure.

The problem is real, but not exactly pressing. Scientists and data specialists will make do with temporary or arbitrary terms (UC Davis students suggested "hellabytes") until the Bureau meets. And, of course, just because we don't have a word for these amounts doesn't mean we can't reach them.

Mike Ryan: 'Django Unchained': Is It Tarantino's Most Disturbing Film? (And 24 Other Urgent Questions)

django unchained

Quentin Tarantino's Django Unchained is, perhaps, the most anticipated movie of the season because, well, it's a movie directed by Quentin Tarantino and people like his movies. With two more ados before we start, the movie stars Jamie Foxx and Christoph Waltz as men hunting bounty in the old South a few years before the Civil War. With one more ado, it also stars Leonardo DiCaprio as a plantation owner who happens to own Django's wife (Kerry Washington). Are there any further ados? There appear to be no further ados. So, with no further ado, we answer every question that you could possibly have about Django Unchained.

Q: Who is Django?

A: Django (Foxx) is a slave who is freed at the beginning of the film by a German named Dr. King Schultz (Christoph Waltz).

Q: Why does Schultz free Django?

A: Schultz is a bounty hunter and Django just happens to be in the position of being able to identify three men - the Brittle Brothers -- that Schultz is currently pursuing.

Q: Is the rest of the movie Schultz and Django chasing down these three men one at a time?

A: The film kind of sets it up that way because the three wanted men used to own Django and his wife, Broomhilda (Washington), and a lot of atrocities occurred during that time period.

Q: So Django Unchained is a tale of revenge? Like Kill Bill?

A: Perhaps these similarities occurred to Tarantino, which is also perhaps why the Brittle Brothers situation is resolved relatively early in the film on a plantation owned by "Big Daddy" Bennett (Don Johnson). After, Schultz enjoys working with Django so much, Django is offered the job of Schultz's bounty hunting partner.

Q: Why would Django want to be a bounty hunter?

A: To earn enough money so that he can at least make an attempt to purchase Broomhilda from a man named Calvin Candie (DiCaprio). Candie happens to be a pretty nasty scoundrel who wagers on slaves who fight each other to the death. A slave who refuses to fight sets up the most disturbing scene I've seen in a theater this year.

Q: Do Django and Schultz simply make Candie a financial offer for Broomhilda?

A: See this is where things go off the rails a bit. Instead of simply trying to purchase Broomhilda, Schultz devises a somewhat harebrained scheme in which he and Django pose as a party interested in purchasing a slave for fighting. The problem is, even though this convoluted plan is fully explained, it's still based on assumptions that Django and Schultz really have no reason to believe are true.

Q: Then why hatch such a convoluted plan?

A: Because if the plan weren't convoluted, this would have been a 90 minute movie.

Q: Was Christoph Waltz revitalized by working with Tarantino again?

A: After winning an Oscar for portraying Col. Hans Landa in Inglourious Basterds, Waltz has been somewhat of a lost soul, appearing in subpar films like The Green Hornet and dreck like Paul W.S. Anderson's The Three Musketeers. Here, Waltz is back at the top of his game and is a joy to watch.

Q: How many The Three Musketeers references does Christoph Waltz make during Django Unchained?

A: One. And, luckily, it was a reference to the book and not that terrible Paul W.S. Anderson movie.

Q: How is Leonardo DiCaprio's performance in Django Unchained?

A: I can't remember watching DiCaprio have this much fun in a role since Catch Me If You Can. (Though, as an aside, be warned that DiCaprio doesn't show up until at least an hour into the film.)

Q: I saw Jonah Hill in the trailer for Django Unchained. Does he play a major role?

A: Jonah Hill has about three minutes of screen time in Django Unchained. But he does happen to be in the best scene in the film.

Q: Does Django Unchained live up to the hype?

A: That really depends on what your individual level of hype is before seeing Django Unchained. If it's very high, the chances are you will be somewhat disappointed.

Q: What are the problems with Django Unchained?

A: Django Unchained just feels overly bloated at 2 hours and 45 minutes. Most specifically, again, when Django and Schultz are in the midst of their grand scheme to fool Candie, it just feels like wasted time watching a plan that we, as an audience, get the feeling isn't going to work anyway. Honestly, there's a tight 120-minute movie in there, somewhere.

Q: What deleted scenes will be on the Django Unchained Blu-ray?

A: I wouldn't be surprised if it's just a video of Quentin Tarantino saying, "Sorry, gang, nothing to see here. I used them all."

Q: Is Django Unchained Quentin Tarantino's most disturbing film?

A: Between the gore, the torture and, most disturbingly, the language - yes. And when I write "language," I'm not talking about a word like "fuck." I'm referencing the language that was used in 19th century United States - and, yes, it's excessive.

Q: Is Django Unchained also Quentin Tarantino's sweetest film?

A: Without giving anything away, strangely, even after all that ... yes, it is.

Q: Will I like Django Unchained?

A: Even while bloated, there's still more than enough good in this movie to warrant me answering "yes" to that question. So, yes, you will. It's worth seeing for the performances alone.

Q: Could anything you have written in that last sentence have stopped me from going to see Django Unchained?

A: No.

Q: What's the best thing about Django Unchained?

A: Samuel L. Jackson. Good grief, is he great. Just the look on his face half of the time had me laughing.

Q: What's the worst thing about Django Unchained?

A: Tarantino's acting.

Q: Who was the last person you expected to see in Django Unchained?

A: Tom Wopat, who played Luke Duke on The Dukes of Hazzard.

Q: What's the last thing you expected to hear during Django Unchained?

A: A Jim Croce song.

Q: The role of Django was originally written for Will Smith. How many times has Will Smith kicked himself today for passing on this role?

A: Even with the film's flaws, Django is still a pretty juicy role. So, three times today.

Q: Is there a post credits scene?

A: Yes. An extremely short scene.

Q: Should I wait through the credits to see this post credits scene?

A: No. Please trust me on this one. You've spent enough time in theaters over the last few weeks. Go out and live your life - it's slipping by faster than you think. (Note: I may be just talking to myself in this answer.)

Goldman lawyer says bank not liable for Dragon founders' losses

BOSTON (Reuters) - A Goldman Sachs Group Inc attorney argued on Tuesday that the bank cannot be liable for the losses of a husband and wife pair who sold their company to a Belgian software firm that collapsed in an accounting fraud, since Goldman had not been hired to seek out a fraud.

The Wall Street giant is facing off in U.S. District Court in Boston against the founders of speech-recognition software company Dragon Systems, who contend they lost their life's work and about $600 million after selling their company to Lernout & Hauspie in an all-stock deal months before L&H collapsed.

"There is no question that Dragon and its stockholders were also defrauded," said John Donovan, an attorney with Boston law firm Ropes & Gray, in his opening remarks defending Goldman in the civil suit. "Goldman's job was not to detect fraud. When you hire a banker, you ask it to do certain things but delving into the books, doing accounting and finding fraud is not one of them."

A day earlier, the attorney for Janet and James Baker, who founded Dragon in 1982 in their suburban Boston home with $30,000, had argued that the couple relied on Goldman's advice in agreeing to sell their firm.

The Bakers owned 51 percent of the company but only were able to sell a few million dollars worth of L&H stock before the company collapsed in an accounting fraud. The Bakers and two other early Dragon employees are seeking several hundred million dollars in damages.

Goldman's reputation has been tarnished in recent years amid allegations that it has treated clients shabbily. Earlier this year one executive leaving the bank published a resignation letter calling the bank a "toxic" place where managing directors referred to their clients as "muppets."

In the months leading up to Dragon's decision to sell to L&H, Dragon management and owners were under intense financial pressure, facing falling sales and a cash crunch, Donovan said.

He said that Goldman had urged Dragon's board to slow the pace of negotiations with L&H and to commission more active accounting reviews of the buyer's results. Instead, Dragon management pushed aggressively ahead, with Janet Baker and a counterpart at their suitor writing out a deal on a piece of paper that changed L&H's offer from cash and stock to all stock, Donovan said.

They pushed ahead with the deal because after a failed 1999 initial public offering, Dragon needed cash to continue, Donovan argued.

"If Goldman had told them to walk away, as they now say Goldman should have, they would have been left with tears in their eyes," he said.

Goldman denied civil claims that include gross negligence and breach of fiduciary duty. The jury trial is expected to last two months.

The Dragon software is now owned by Nuance Communications Inc .

Is Your Snoring Disturbing The Peace? Get Help Here! - Health Care

Snoring causes a lot of inconvenience and aggravation. Whether you or your loved one is the snorer, it is very troublesome. The sound of someone snoring is very annoying and it can affect another person?s ability to get a good sleep. Fortunately, there are a number of steps you can take to reduce your snoring. There are several ways you can deal with snoring, and this article serves to provide you with advice on some of them.

To prevent snoring, avoid alcohol and sleeping pills. Both are central nervous system depressants that can relax the muscles in your throat and cause you to snore. These drugs can cause sleep apnea as well, resulting in vulnerability to cardiovascular disease. Therefore it is crucial that you avoid these substances.

Those who snore should always try to sleep on their sides rather than on their backs. Studies show that snoring is not as likely to happen if you sleep on your side. While it could take a while to get used to, this is a wonderful way to stop one?s snoring.

The amount of sleep you get each day will affect how badly you snore. Keeping a consistent sleep schedule is just as important as how much you sleep. Go to bed and wake up at the same time every day.

One simple way to reduce snoring is to watch your sleeping position. The force of gravity on your head and neck in a supine position can cause your airway to collapse. Sleeping on your side reduces stress on your neck and decreases your likelihood of snoring.

Ironically, by taking sleeping pills, you could end up snoring. Therefore, if you do not take them, you will greatly reduce the risk of snoring. Sleeping pills cause all of the muscles in your body to relax. Muscles that hold your nasal airways open will relax, causing them to slacken. This will cause you to snore in your sleep.

If you snore, it is wise to have a humidifier on when going to sleep. Having a humidifier on lets moisture get into your throat, which clears your passageway, allowing you to breathe better when sleeping.

Prescription medications may be causing your snoring, speak with your doctor about it. Some prescription medicines tend to cause snoring. Sleeping pills, muscle relaxers, pain killers, and antihistamines can all make the muscles in your neck too relaxed, leading to airway restriction. These airway restrictions create a snoring environment.

Seriously think about quitting smoking if you snore and are a smoker. Smoking causes the throat tissues to become irritated, and this can lead to a swelling of your throat. Swelling of the throat is often the cause of snoring.

If you often snore, consider allergies as a possible culprit and find a remedy for them. Allergies that go untreated can make the nasal passage swell; when that happens, you will have no choice but to inhale and exhale through your mouth. These symptoms typically lead to snoring. If you have mild allergies, get a non-prescription medication or go to your doctor if you have a severe allergy

Snoring can be a very annoying condition. Not only can the sound be unpleasant, it can also keep those around you from getting a goods night rest. All snorers can rejoice in the fact that effective treatments are now readily available. By reading this article, you have encountered just a few of the possible techniques you can make use of. Use this advice wisely to tackle any persistent snoring problems.

Your Willpower Is Only a Finite Resource if You Believe It Is

Your Willpower Is Only a Finite Resource if You Believe It IsWe've often noted that willpower is a finite resource, but it seems that's only the case if you believe it. According to a few studies.

Christian Jarret at productivity and ideas blog the 99u explains:

Veronika Job at the University of Zurich and her colleagues at Stanford University tested this by asking 60 students whether willpower is a limited resource that's depleted by effort, or if it's potentially unlimited and recharged by a challenge. Next, the students were given two taxing mental tasks in succession. The first was an awkward editing task, the second involved naming the actual color of color words while ignoring their meaning (e.g. the word "green" written in red).

For students who believed that willpower is a limited resource, giving them an extra tricky editing task left them frazzled for the color-naming challenge and their performance suffered as a result. It was a different story for the students who saw their willpower as unlimited. They performed just as well on the color-naming challenge regardless of whether the editing task was made extra difficult or not. In other words, whatever the students believed about willpower ended up coming true.

Of course, this is a small sampling and some students may have had more willpower than others. Nevertheless, a Stanford study found that it's actually very easy to change mindsets and override what appears to be low willpower. The takeaway is pretty simple: look at tasks as bigger challenges that you want to overcome and you'll find the willpower you need. That's easier said than done, of course, but it sounds like it won't take much more than regular reminders.

For much more detail on the subject, be sure to read the full post over at the 99u.

Margo Martindale joins FX's "The Americans"

NEW YORK (TheWrap.com) - Margo Martindale, who won an Emmy for her role on FX's "Justified," is returning to the network on the new spy series "The Americans."

The show, which stars Matthew Rhys and Keri Russell as an undercover KGB couple in Reagan-era America, premieres January 30. Martindale has signed on to appear in at least eight episodes as "Claudia," a KGB illegal who delivers assignments to the couple.

The casting reunites Martindale with "Justified" creator Graham Yost, an executive producer of "The Americans." Martindale won the Emmy Award for Outstanding Supporting Actress in a Drama Series for her performance as Mags Bennett on "Justified."

Since her exit from the show, Yost has talked about how much he misses working with the actress.

"What I do regret is just not having Margo on the show, in that she's such a tremendous actress and such a great person," he told TheWrap. "That was the hard part."

Since leaving "Justified," Martindale has appeared on CBS's now-canceled "A Gifted Man" and has signed on for Showtime's "Masters of Sex."

"The Americans" was created by former CIA agent Joe Weisberg, who also executive produces. Besides Yost, it is also executive produced by Joel Fields and Amblin Television heads Justin Falvey and Darryl Frank. The series is produced by Fox Television Studios and FX Productions.

Napoleon Wasn?t Defeated by the Russians

Adolph Northen's (1828-1876) painting of "Napoleon's Eetreat from Moscow". "Napoleon's Retreat from Moscow"

Painting by Adolph Northen/Wiki Commons.

History has taught us that Napoleon, in his invasion of Russia in 1812, marched into Moscow with his army largely intact and retreated only because the citizens of Moscow burned three-fourths of the city, depriving the army of food and supplies. The harsh Russian winter then devastated the army as it retreated. The Russians? victory, commemorated by Tchaikovsky?s 1812 Overture, was one of the great upsets of military history.

But no one recognized the truly great power in this war.

In Vilnius, Lithuania, during the winter of 2001, workers were digging trenches for telephone lines and demolishing the old Soviet barracks that had stood for decades. A bulldozer scraped-up something white, so the operator hopped down and, to his surprise, saw the skull and other bones of a human being. Another worker later claimed that ?the things just kept coming out of the ground?there were thousands of them.? Eight years earlier, a grave had been found with the remains of 700 people killed by the Soviet Committee for State Security, commonly known as the KGB. Could this be one of those secret places where the KGB disposed of its victims? Or could it be one the mass burials of Jews murdered by the Nazis?

When archeologists from the University of Vilnius arrived, they found that the bodies were stacked three deep in V-shaped trenches that were apparently dug as defensive positions. It appeared that the skeletons were the remains of soldiers. Two thousand skeletons were excavated, along with belt buckles with regimental numbers on them. Along with the finds were 20-franc coins dating from the early 1800s. It finally dawned on the scientists what they had found: the remains of Napoleon?s Grande Arm?e. Napoleon had led 600,000 men into Russia with the intent of conquering the country;of these, only about 30,000 survived, and of that number, it is said that fewer than 1,000 were ever able to return to duty.

What incredible circumstances could have caused the defeat of one of the greatest armies on the European continent, led by one of the greatest generals of all time? Surprisingly, it wasn?t enemy soldiers or the normal privations soldiers experience that devastated Napoleon?s army. Most of his soldiers were battle-hardened young men, so they should have been able to tolerate the cold, hunger, long marches, and fatigue. No, it was a microscopic organism that wreaked havoc and annihilated Napoleon?s army and his grand plans for conquest. A microbe called typhus, spread by a scourge of lice.

Napoleon initially had no real reason to invade Russia. During the Battle of Friedland in June of 1807, Napoleon?s army defeated the Russian army, and on July 7, 1807, France and Alexander I of Russia signed the Treaties of Tilsit, which made the two countries allies (and, among other things, prohibited Russia from doing business with Britain). Surprisingly, Napoleon did not take any land from Russia or request war reparations. By early 1812, Napoleon controlled most of the land between Spain and Russia. However, England controlled the seas, and Napoleon wanted India, which was then an English colony. Napoleon?s only hope of taking India was to take it by land, which meant controlling Russia.

Since the Treaty of Tilsit, France and Russia had been tense allies. Russia had been violating the treaty by trading with England, and Napoleon, finally fed up, used this as an excuse to invade Russia. In June, 1812, Napoleon?s army assembled in eastern Germany. With magnificent fanfare, Napoleon reviewed his troops on the west bank of the Niemen River on June 22, 1812. Napoleon?s engineers built a pontoon bridge over the river and the army entered Russian-controlled Poland the next day. Things were going well?the summer, though hot and dry, made marching over the roads easy. The supply columns stayed slightly ahead of the soldiers, so food was readily available, and the soldiers were in good health. Though military hospitals were established along the route to Poland in Magdeburg, Erfurt, Posen, and Berlin, there was little need for their services. The army reached Vilnius in four days, meeting no resistance from Russian troops.

Poland is where things started going badly for Napoleon. He found the region filthy beyond belief. The peasants were unwashed, with matted hair and ridden with lice and fleas, and the wells were fouled. Since the army was now in enemy territory, the supply trains had to move to the rear. The roads were soft with loose dust or were deeply rutted from the spring rains; the supply trains lagged farther and farther behind the main body of soldiers, and it became difficult to provide food and water. The army was so huge that it was nearly impossible to keep military formation intact, and the greater part of the army dissolved into straggling, sprawling mobs. Many of the soldiers pillaged the homes, livestock, and fields of the local peasants. Nearly 20,000 army horses died from lack of water and fodder on the way to Vilnius. The homes of the peasants were so filthy that they seemed to be alive with cockroaches. The typical battlefield diseases of dysentery and other intestinal diseases began to appear, and though new hospitals were set up in Danzig, K?nigsberg, and Thorn, they were unable to deal with the large numbers of sick soldiers sent back to the rear.

But Napoleon?s problems were just beginning.

Good safety management can lower ACC levies | infonews.co.nz ...

The Government is introducing a range of incentives to help business owners focus on improved safety management and make work places safer, ACC Minister Judith Collins says.

New Motor Vehicle Account levy classes for goods and service vehicles will better reflect the risks posed by heavier trucks that will now be levied by weight, as well as by fuel type.

?It?s important that we recognise some forms of transport pose higher safety risks, and should attract a levy rate that reflects that risk.

?Owners of light goods and services vehicles (GSVs) have been subsidising the owners of heavy GSVs by $12million per year. So, there will be new levy rates for GSVs based on a weight of more or less than 3.5 tonnes.

?This will mean a small increase in levy rate for the approx. 111,000 heavy trucks on our roads, and a reduction in levies for the 341,000 light vehicles. This is a much fairer and more accurate way to set the levies,? Ms Collins says.

Heavy vehicle owners will be able to offset any increase in their levies by joining a new Fleet Safety Incentive Programme.

Truck owners with good safety management standards are able to reduce their levies by meeting audited standards for fleet management systems and performance.

The Workplace Safety Discount scheme of 10 per cent reduction in levies will also be extended to all industries. Currently it is only available to certain small employers in selected industries. To qualify for the discount, companies will have to demonstrate adequate experience in health and safety systems and complete a self-assessment based audit.

?A key priority for this Government is an increased focus on health and safety systems. We?re providing a range of incentives for raising the standard of safety management across New Zealand businesses and making workplaces safer,? Ms Collins says.

For more information about the new levy classes for GSVs, Fleet Safety Incentive Programme, or the extended Workplace Safety Discount, go to www.acc.co.nz.

Multilevel marketing still grows well | SaigonMoney.com - The digital ...

Despite economic woes, sales via multilevel marketing in Vietnam have steadily increased with over one million people involved in network marketing.

According to the Vietnam Competition Authority under the Ministry of Industry and Trade, sales via multilevel marketing last year reached VND4.05 trillion, equivalent to some US$193 million, up 170% from the previous year.

Statistics showed that there were only around 235,000 people joining multilevel marketing organizations in 2006, and the number of participants increased by over 4.6 times last year to over one million.

Ha Thi Quynh Tram, chairwoman of the AmCham Vietnam Direct Selling Committee (AVDSC), told that Daily last week that although official statistics on this year?s sales of multilevel marketing companies were not available, the market had steadily grown.

Explaining the growth, Tram said that as the economy was in difficulty, many people were getting involved in multilevel marketing as a way of earning some money.

It is low investment costs, few risks and flexible time that have helped attract over 125,000 people nationwide joining direct selling networks last year.

Over ten years of presence in Vietnam, there have been 78 companies registering for the multilevel marketing business here, according to the Ministry of Industry and Trade.

By last month, 54 companies had been operational, with 13 foreign-invested ones. Meanwhile, other companies have suspended operations or had their licenses revoked.

Hanoi has the highest number of direct selling companies with 28 operational firms among 40 registered ones, while the respective figures in HCMC are 23 and 34 respectively.

According to the Ministry of Industry and Trade, 90% of such firms sell functional food which is followed by cosmetics, fashion products and home appliances. The number of products has also increased much in recent years with around 4,500 products going on sale last year.

Experts said that as the market would be further opened up under WTO commitments, there would be more companies joining the multilevel marketing market, especially those from foreign countries.

However, direct selling operations in Vietnam have left many scandals in the past. The most typical case is that producers require agents to obtain a certain sales volume, pay high commissions and even cheat customers.

At a seminar on multilevel marketing held last week by AVDSC, experts said companies needed to apply the code of conduct on business ethics in their operations.

The code of conduct, according to Tamuna Gabilaia, executive director of the World Federation of Direct Selling Associations, consists of three important parts, which are to protect consumers, protect distributors and solve complaints between companies.

Man strips at Austrian art exhibition of nude men

VIENNA (AP) ? An Austrian museum says a man took the concept of life imitating art to an extreme when he suddenly stripped at an exhibition of pictures and sculptures portraying nude men through the ages.

Vienna's Leopold Museum says that after taking his clothes off, the man calmly sauntered through the exhibition, dressing again only after a security guard asked him to do so.

Museum spokesman Klaus Pokorny said Tuesday that the museum had nothing to do with Saturday's strip, describing it as a "spontaneous act." He says other visitors did not appear disturbed.

He said that since its Oct. 19 opening, the "Nude Men" exhibition had attracted more than 65,000 visitors ? all of them dressed except for one.

FAA: 3 killed in medical helicopter crash in Ill.

(AP) ? Authorities say a medical helicopter has crashed in northern Illinois, killing all three people on board.

The Federal Aviation Administration reports the helicopter crashed Monday night while traveling from Rockford, near the Wisconsin border, to a hospital about 60 miles south in Mendota.

The helicopter was registered to Rockford Memorial Hospital. Hospital spokeswoman Laura Maher says no patients were on board when the helicopter crashed around 8:30 p.m. into a field in Rochelle, about midway between the two cities.

Maher didn't immediately have information about the flight crew, but says crews generally consist of two nurses and a pilot.

The FAA says the helicopter was destroyed and all three people on board were killed.

Rockford is about 80 miles northwest of Chicago.

Residents unable to return home after N.J. train derailment

PAULSBORO, N.J. (AP) ? It's not clear how long it will take workers to clear a hazardous gas from a ruptured tank car that derailed from a freight train in southern New Jersey last week.

More than 100 Paulsboro residents won't able to return to their homes in the 12-block evacuation zone until at least Saturday.

Officials must remove the vinyl chloride before they can clear the track and examine what caused Friday's derailment.

Federal investigators said Sunday that Conrail crews had studied reported signal problems at the railroad bridge where the derailment occurred.

The National Transportation Safety Board is reviewing records with a focus on both the reported signal problems and a 2009 train derailment on the same bridge.

Dozens of people went to a hospital with breathing and other issues after the derailment, but no serious injuries have been reported.
