PolitiFact Ratings Point to Obama's Successful Initiatives and Stalled ...

As the presidential election dominates the news over the next few weeks, PolitiFact ? a fact-checking website sponsored by the Tampa Bay Times ? has released an analysis of then-Senator Obama?s 2008 campaign promises, as well as promises made by Republican party leadership during the 2010 congressional elections.

It?s telling that not one of the 57 GOP promises rated by PolitiFact is directly related to education or children.

But of 508 of the president?s promises rated, several dozen are early childhood- or education-related. They range from home visitation for low-income expectant mothers (Promise Kept) to requiring that all schools of education be accredited (Stalled).? And a surprising number of them are promises specific to early education.

Back in 2008, the Obama campaign promised a ?Children?s First? agenda ? a series of initiatives that emphasized children from birth to age 5. Four years later, PolitiFact rated the administration?s progress as ?Compromise.?? Though the group notes it found no evidence of an agenda labeled ?Children?s First,? a number of smaller birth-to-five projects like home visiting, the Race to the Top-Early Learning Challenge, and Head Start quality efforts have been pushed, and each one of those has been achieved.

Lisa Guernsey, director of the Early Education Initiative, spoke to the PolitiFact researchers, saying that while there?s plenty left undone, the administration has nonetheless pushed ?the conversation of early childhood care so that it is connected to early education.? And, she said, federal funding cuts have mostly spared early learning programs. In some cases, early education programs have even seen funding boosts, a rarity throughout the recession.

And in response to a promise to provide ?affordable and high quality? child care, PolitiFact deemed the president?s score a ?Promise Kept.? The rationale for the rating is $2 billion in stimulus funding funneled into the Child Care and Development Block Grant (CCDBG).? Still, it is difficult to say that promise is complete, given that a report by Child Care Aware? of America found that in 35 states and the District of Columbia, child care costs are, on average, higher even than in-state tuition.

The website also ranked the president?s promise to ?promote more preschool education? as a Promise Kept, citing the $500 million Race to the Top-Early Learning Challenge program.? But even though that program did incent states to reform and strengthen their early learning policies, as well as flush some extra money into building an early learning infrastructure, there?s still plenty of work left to do. The program did not increase the number of slots for high-quality pre-K programs and per-pupil funding for pre-K has declined by more than $700 per child over the past nine years. Early Ed Watch?s sister initiative, the Federal Education Budget Project, now displays in its PreK-12 database state- and school district-level data on state-funded pre-K, Head Start, and special education preschool grants. The data show gaping holes in available data, especially at the local level, and insufficient access in many states to publicly funded pre-K programs. Promises to quadruple Early Head Start, grow funding for Head Start, and improve quality in both programs, meanwhile, were rated Compromise.? Instead of quadrupling Early Head Start as he promised, the president nearly doubled enrollment in the program thanks to extra stimulus cash. He did increase funding for Head Start, but PolitiFact also credits the $500 million Race to the Top-Early Learning Challenge to efforts to increase Head Start funding because much of it was dedicated to improving the administrative side of all early learning programs ? including, but not limited to, Head Start. And with several new quality improvement and enforcement mechanisms in place, PolitiFact considered the president?s third Head Start promise a success.?

Debate impressions: A reversal in body language?

(AP) ? Big Bird, binders and ... bayonets! Well, at last we know the three Twitter memes of the debate season ? and they all start with 'B.'

But beyond President Barack Obama's 'bayonet' zinger ? more on that in a moment ? the final presidential debate was notable for how the two candidates, in ways verbal and nonverbal, switched roles in a sense from their first debate. This time, political communication analysts say, Mitt Romney seemed more passive and defensive, and Obama more forceful and in command.

And speaking of that word "command," the president was eager to use it whenever he could ? to show how he and only he had the policies, temperament and experience for the top job. "As commander in chief .. " Obama began more than one answer.

Did his tactics work? Some impressions from the third and last presidential debate, from analysts of political communication and body language:

PLAYING TO WIN, OR FOR A DRAW

Let's get the sports analogies over with: Some analysts focused on how Romney was playing it safe this time ? or "playing for a draw," in the words of Jonathan Paul, director of debate at Georgetown University. "That seemed to be his strategy in the questions of foreign policy." In other words, first make no mistakes.

"Romney's purpose was not to lose," said Jerry Shuster, who teaches political communication at the University of Pittsburgh. "He was underplaying, almost demure. Attack was not part of his strategy." Analysts noted, though, that this may have been the least risky strategy when dealing with issues of foreign policy.

As for Obama, he knew he had to come appearing presidential and leader-like, and he did so, Shuster said: "He came prepared to be presidential and prepared to win."

THE GREAT PIVOT

Call it the great pivot: Romney managed to veer the conversation a number of times to domestic issues, an area where he had more definitive things to say.

"You could tell he didn't want this debate to be about foreign policy ? he wanted it to be about jobs and China," Paul said.

But did it work? It probably depended on who was listening. "I call it deviation, rather than a pivot," Shuster said.

The difference on Monday night, added Paul, was that as opposed to the first debate, Obama was better prepared to answer those domestic questions.

BODY LANGUAGE: NO MORE BOXING, A LITTLE SWEAT

What happened to the boxing match (sorry, another sports analogy) that was the second presidential debate?

Thanks mostly to the change in format ? the second debate was a town-hall style meeting, whereas on Monday night the candidates were seated at a small desk ? the debate was a lot less physical. You didn't see a lot of personal space violations.

There was also less room for the interruptions, on both sides, that bothered some viewers in the second debate.

But even though the two men were sitting down and close to each other, there was some fodder for body language experts like Lillian Glass, a body language coach in Los Angeles.

"Romney was definitely nervous," Glass said. "He was sweating on his upper lip. That's the nervous system kicking in."

However, Glass liked the body language that Romney exhibited later in the debate, a back-straight posture that she termed "powerful."

"They both were at the top of the game," she said. "It was a draw. They both get As."

FACIAL EXPRESSIONS

Most analysts, though, felt Obama was more successful than his opponent in getting across the message he needed to: that he was the presidential one. Facial expressions reinforced that.

"Romney seemed to frown a lot," Glass said.

As for Obama, "The president made good eye contact, balancing it between his opponent and the moderator," Shuster said. "He also maintained a steady gaze, as if to say, 'What I am saying is on target.'" Shuster saw Romney's expression as more a grin than a frown or a smirk, as some called it ? albeit a very uneasy grin.

"He had that grin when he listened to Obama, which to me said, 'I don't know what I'm going to say in response to this,'" Shuster said.

I AGREE, PART TWO:

The responses Romney did give were problematic for him on another level, said Kathleen Hall Jamieson, a professor of political communication at the University of Pennsylvania. While Obama got flak in Denver for nodding in agreement with his opponent, this time it was Romney who found himself agreeing with a number of Obama's pronouncements on foreign policy.

"You can't indict someone for a foreign policy you basically agree with," Jamieson said. And that was compounded by Romney's apparent reluctance to rebut a number of Obama's criticisms, she said.

"The danger for Romney is that he didn't respond to charges that he's inconsistent," Jamieson said. "He didn't specifically rebut much of anything."

Romney's moderate responses did have one big advantage, Jamieson added: They probably helped reverse the perception among some that he would be more likely to bring the country to war. She says a survey by the Annenberg Public Policy Center at the University of Pennsylvania has indicated that perception is a vulnerability for Romney.

HUMOR VS SNARK: THE BAYONET MOMENT

Who knew that Big Bird would have a moment this election season? And wasn't it even weirder when it was binders, that essential school supply, that emerged in the sunlight?

This time it was bayonets, after an Obama comment that was the most tweeted all evening and is probably just in the early stages of its pop-culture shelf life. When Romney repeated his criticism that the U.S. Navy is too small and has fewer ships than it did in 1916, Obama was ready:

"Well, governor, we also have fewer horses and bayonets," Obama said, painting Romney as out of touch. "We have these things called 'aircraft carriers', and planes land on them."

Was it snark, or simply a clever use of humor?

"I thought it was very effective ? one of his best moments," said Paul, the Georgetown debate coach.

Shuster, at the University of Pittsburgh, said the best thing about the remark was how it illustrated, pithily, the president's view on military spending ? one of the few foreign policy areas on which the candidates have real disagreements.

DOES IT ALL MATTER?

Now the existential question: Does any of it matter to the election results?

Pundits universally declared Romney the winner of the first debate, and Obama the winner, albeit by a much narrower margin, of the second. The president was perceived by many to have won the third, but perhaps a tweet from Larry Sabato, director of the University of Virginia's Center for Politics, said it best.

"Glancing down Twitter," he tweeted. "Shocker: All D's think O won, all R's think R won."

Random shootings prompt school lockdowns in Mich.

WIXOM, Mich. (AP) ? Kids were kept off school playgrounds Monday and some commuters changed their routes as police searched for a suspect in 20 random shootings that have mostly damaged vehicles on busy roads across four Michigan counties.

No one has been hurt, and no shootings have occurred since Thursday. But police on Monday added to their list two more incidents from the small city of Perry, off U.S. 69, stretching the investigation to four counties, Oakland County Undersheriff Mike McCabe said.

Tipsters told police the gunman appears to be a man in his 30s and authorities on Sunday released a drawing of a possible suspect with close-cropped hair and stubble on his cheeks and chin. While the incidents appear to be random, police are investigating them as a pack and have formed a task force to chase down tips.

The shootings mostly involve cars near Interstate 96, though authorities have said one occurred while a man was taking out his garbage. In another incident, a woman said the rear window on her car was shattered. Ten of the 20 shootings have occurred in Wixom, 35 miles northwest of Detroit.

In the Walled Lake district, officials felt compelled to lock doors at five schools in Wixom and hold recess indoors on a beautiful fall day, though there is no evidence schools are a target. They're not sure how long the policy will be in effect.

"We want all our students and families to feel safe. These are precautionary measures," school spokeswoman Judy Evola said.

The shootings were a hot topic on morning drive-time radio shows with listeners calling or texting their plans to avoid I-96 in certain areas.

"You can never be too careful, obviously," McCabe said. "Until this guy or suspects are found, people need to be aware of their surroundings. There is nothing wrong with taking precautions. We're not going to tell people they're overreacting."

The shootings have occurred in Oakland, Livingston, Ingham and Shiawassee counties, from last Tuesday through Thursday.

Egypt prosecutor to probe election challenges

CAIRO (AP) ? Egypt's prosecutor general ordered Monday an investigation into allegations of irregularities and forgery in the presidential election, after the candidate who narrowly lost filed a complaint and said he remained in politics despite facing corruption charges.

Mohammed Morsi of the Muslim Brotherhood edged out Ahmed Shafiq to win Egypt's highest office in the nation's first freely contested presidential vote last summer. Shafiq left the country with his family to the United Arab Emirates soon after the results were announced, without explanation at the time. But he has since said he will continue his political career, pledging to return to Egypt soon and found a new party.

Litigation against Shafiq followed his departure, with a number of investigations and court cases accusing him of corruption during his long political career under former President Hosni Mubarak, ousted in a popular revolt last year.

Egypt has seen a rising number of legal disputes between political rivals in the days following the election, as the nation struggles with an increasingly polarized political atmosphere. Shafiq had always denied the corruption charges, saying they are politically motivated by his rivals.

His call for an investigation of the election results came a day after authorities froze his and his family's assets as part of a probe into his wealth? the latest legal move against him.

After the decision, he told Egyptian media from abroad that he will have a "fierce" response to allegations that aim to "smear" his reputation. He again denied the corruption charges and said he will contest the election results, calling the alleged rigging "a crime."

"For sure there was rigging (in the elections)," Shafiq told a private TV station late Sunday. "I had information that I was a winner. But by God's will and people's will, the decision turned out this way ... I had no doubt there was forgery during the election process."

Shafiq has previously complained that some ballots were forged, that invisible ink was used during voting, and that some Christians were prevented from casting ballots. He said the incidents favored Morsi.

In Sunday's interview with private broadcaster Al-Youm, Shafiq said he has evidence of rigging and vote buying by Morsi, claiming that previous investigations into the allegations had been unfairly stopped. In another interview, he said he was not an "easy" rival. "I am continuing my political career in spite of anyone," he said.

It was unclear what the probe ordered Monday could lead to, or whether the country's top job can now be challenged because of a criminal investigation. The president's office had no immediate comment on the new investigation.

The presidential election commission, whose decisions are unchallengeable, had earlier dismissed the same complaints from Shafiq after investigating them.

A member of the presidential election committee, judge Hatem Bagato, told the website of state-run Al-Ahram newspaper that an investigation into a criminal case is different from his panel's investigation.

"We will wait for the investigation by the general prosecution to take necessary measures. The committee has no relation with the case right now," Bagato said when asked if the president's job is now in jeopardy.

In a separate legal dispute, a flamboyant TV presenter, Tawfiq Okasha, who was cleared from earlier charges of insulting President Morsi and inciting violence against him, was slapped with a four-month sentence and a fine on similar charges.

Okasha will likely appeal the decision. The lawyer who filed the case, Ayman el-Tawil, said he presented evidence to the court of live programs during which Okasha offended Morsi, questioning his victory in the elections.

In one program, nearly a month after Morsi was sworn in, Okasha said that he considers Egypt has no president, el-Tawil said, reading from the evidence he presented to the court.

1 dead, 4 seriously injured in Arizona bus crash

WILLOW BEACH, Ariz. (AP) ? A tour bus careened off the road and crashed in northwest Arizona late Friday, killing the driver and leaving at least four passengers with serious injuries, authorities said.

About 45 other passengers were less seriously hurt and not all of them required hospital treatment, the Arizona Highway Patrol said.

The crash occurred shortly before 8 p.m. PDT on Highway 93 near Willow Beach, about 20 miles from the Nevada state line and 40 miles southeast of Las Vegas.

The bus was northbound when it went off the road and into a ravine. No other vehicles were involved.

"We believed the driver experienced some sort of the medical condition and he just went off the road," the patrol said.

The most seriously hurt were flown by helicopter to hospitals, while other passengers were taken by ground ambulance.

Six were flown to University Medical Center in Las Vegas, where they were being treated for nonlife-threatening injuries, hospital spokeswoman Danita Cohen said.

She described them as being mostly over 50 years old and suffering from broken bones and lacerations.

The patrol statement said officers were trying to determine what happened to the bus after it went off the roadway. The front end was heavily damaged.

Four hours after the crash, the bus was sitting upright about 30 feet off the shoulder of the road.

It appeared to have at first gone down a ravine before traveling up an embankment.

The highway near the crash site was reduced to one lane of traffic.

A bus crash nearby nearly four years ago killed four people.

Authorities said a charter bus carrying a group of Chinese tourists on a return trip to Las Vegas from the Grand Canyon on Jan. 30, 2009, crashed on U.S. 93 near Hoover Dam. Ten others were injured, including the driver.

Lawyer tells jurors about Britney Spears' life

(AP) ? A lawyer for Britney Spears' father told jurors Friday that the singer's family went to heroic efforts to save her during a well-chronicled public meltdown that included shaving her head and other bizarre behavior.

Spears' father, Jamie, in particular went to great lengths, attorney Leon Gladstone said during opening statements in the trial of a lawsuit Spears' former manager Sam Lutfi has brought against Spears and her parents.

Gladstone said Spears' life began to spiral out of control after a painful breakup with childhood sweetheart Justin Timberlake.

Jamie Spears worked tirelessly, Gladstone said, to rescue his daughter from drug addiction, mental illness and the hold that Lutfi had on her during that time.

Gladstone told of Jamie Spears' going to the hospital where his daughter was in a psychiatric ward, staying up with her all night and trying to bring her back to normalcy.

"To Jamie, this is a battle for life or death, and Britney is at her most vulnerable," Gladstone said.

He told of another day that Jamie Spears rushed to a hospital, where he found Britney strapped to a gurney, screaming and yelling. "She is completely unhinged. He stays with her, walking the floor. He is scared out of his mind. He's thinking, 'My daughter has lost everything.'"

The attorney said Jamie Spears expected to turn on the TV one day and learn that his daughter had died.

During this period, Gladstone said, Lutfi was of no help. Jamie Spears confronted Lutfi in the kitchen of Britney's house and told him "leave my daughter alone, get out of our lives."

"And at that point Jamie touched Lutfi. For that, Jamie is being sued for battery," Gladstone said. He said Lutfi was not hurt and was out that night with Britney.

Gladstone added that when Jamie Spears went to court and asked for conservatorship of his daughter it was immediately granted and remains in effect.

Jamie Spears and Britney's mother, Lynne, sat in the courtroom listening to the opening statements.

Another lawyer, Joel Boxer, who represents the conservators of the star, described Lutfi as a man who exploited his friendship and trust with her and styled himself as her manager when he knew nothing of the business. Boxer said that during a deposition, Lutfi was asked how he knew about the world of music, and he said, "It's something you learn by osmosis living in LA."

Lutfi never told Spears' lawyers or her business manager that he was in charge of her affairs, never arranged any business deals for her, and now claims he's entitled to 15 percent of her gross income during his tenure as manager, Boxer said.

"He was a destructive voice in her life. Sam Lutfi tried to take advantage of a very vulnerable Britney Spears," Boxer told the jurors. "Whether he gets away with it is a chapter written by you, ladies and gentlemen."

During his opening statement on Thursday, Lutfi's lawyer said his client never took advantage of Spears.

Lutfi himself was trying to help Spears, attorney Joseph Schleimer told jurors, but lost control as her behavior became more troublesome and she was eventually hospitalized and put under a court-ordered conservatorship.

Lutfi is seeking millions of dollars from Spears and her family, claiming a book her mother wrote detailing that time lied about him drugging and isolating the pop superstar. He is also seeking a portion of Spears' profits from her recording career, claiming he was a key player in her 2007 album "Blackout" and had the right to serve as her manager for years.

The case is the culmination of years of acrimony between Lutfi and Spears' family and conservators, who successfully obtained a restraining order against him to keep him from contacting the singer or trying to intervene in her life. The order has expired, but conservatorship attorneys are seeking repayment for more than $93,000 in legal fees ? a judgment Lutfi is appealing.

Lutfi sued in February 2009, roughly a year after Spears was hospitalized and placed under the conservatorship to take control of her health and finances. The move by Jamie Spears came after months of erratic behavior by his daughter, including shaving her head, speaking in a British accent, attacking a car with an umbrella and other bizarre incidents. She also lost custody of her two sons with ex-husband Kevin Federline during that time.

Jurors aren't expected to hear from Spears during the trial. She remains under the conservatorship, which is overseen by a judge who has ordered her not to appear for trial or a deposition.

She has since made a remarkable comeback and is a judge on the Fox television show "The X-Factor."

Gold Fields strike ends, 1,500 sacked as S.Africa trouble simmers

JOHANNESBURG (Reuters) - South African workers officially ended a month-long strike at major bullion producer Gold Fields on Friday but there was still no end in sight for wildcat walkouts that have paralysed other gold and platinum producers.

More than 80,000 miners have downed tools in the resource-rich country since August in often violent strikes over pay and working conditions that are hitting growth and investor confidence in Africa's biggest economy and raising questions about President Jacob Zuma's leadership.

Nearly 50 people have died in labour strife since August, including 34 striking miners shot dead on August 16 at Lonmin's Marikana mine in the deadliest security incident since the end of white-minority rule.

Thousands of Lonmin workers staged a one-day walkout on Thursday to protest against the arrests of colleagues who are suspected of murdering rival labour leaders. Lonmin said on Friday it was back to normal operations.

Gold Fields, the world's No. 4 producer, said about 11,000 workers, threatened with dismissal if they did not return by Thursday, have returned to work at its KDC West operations in Carletonville, 40 km (25 miles) west of Johannesburg.

"At KDC West the strike is officially over. The 1,500 employees who did not report for work before Thursday's deadline were dismissed but have until midday on Friday to appeal their dismissal," said company spokesman Sven Lunsche.

On Thursday, all of the 9,000 workers at its Beatrix mine in the Free State province returned and Lunsche said the remaining 8,500 on strike at its KDC East operations would be issued an ultimatum "anytime now".

"The raiding of hostels and disarming of strikers gave workers the confidence to return to work," said Lunsche.

AngloGold Ashanti, the world's No. 3 gold producer, is relying on negotiations at the Chamber of Mines to end the strikes at its South African operations.

Gold companies represented by the chamber on Thursday tweaked a proposal to lift the pay of the lowest paid workers in a bid to end the illegal strikes.

The labour unrest has hit at the heart of the post-apartheid economic structure where the ruling African National Congress and its union allies would insure a steady supply of labour for industry in return for moderate pay increases.

Strikers have often said union bosses are more concerned about keeping close ties with politicians and company bosses than protecting workers in mine shafts.

"Harmony's Kusasalethu is still on an unprotected strike. Other operations in Harmony are still in operation," said Harmony Gold Mining spokeswoman Henrika Basterfield.

A month-long strike at Anglo American Platinum is no closer to ending. The company has sacked 12,000 at its Rustenburg operations.

Myth #1 - You need a lot of money. The reality is that most people don?t have a lot of this. I did some research and it?s amazing how little you need to start a business. For me, I was looking for a business I was passionate about and did not require a huge investment upfront on my part.

Myth #2 - You need to have experience. If most people are like me, most of those things I have experience in would be hard to translate into a business, or into something I was passionate about doing as a business. So for some, it may just be a matter of finding a business that you would really enjoy or something you can easily learn how to do.

Myth #3 - You need a lot of time.

It seems time is something everyone is having a hard time finding these days. I guess what David meant is the fear around being told that once you start a business, it is going to require a lot of your time.

Time away from family, friends, loved ones. You all have heard it. Every waking minute is going to be spent in or on the business. I guess for some people that may be true.

But it doesn?t have to be. There are many businesses that you can start part time. Then as the business becomes successful, you can decide to remain part time or go full time.

You may also discover that as the business becomes successful you will have more time to do the things you always wanted to do like travel, volunteer, or spend more time with friends and love ones. ?

Myth #4 - Nine out of Ten businesses fail. I cannot tell you the number of times I have heard or read this. If I had a dollar for every time I heard it, I would not have to start a business because I would already have enough to retire rich. This myth may be the single biggest reason why many simple business ideas never get off the ground.

Today with a few simple business ideas, passion and commitment you can start a business. Just look on the internet with all the successful online businesses. The opportunities are greater today than they have ever been.

Myth #6 - You have to be passionate about the particular business you choose. Thanks again David for putting another myth to rest. Like before, I cannot tell you the number of times I heard you have to be passionate about what you are selling, passionate about the company.

As David pointed out, this is not necessarily true. What if you like the product but not love it, but the product has an excellent marketing system, training, support, customer service, etc.

And what if you are more passionate about ?WHY? you are starting a business more than the product itself? Is your passion for the ?WHY? enough to make you successful? Some may disagree, but something to think about.

It still amazes me that I am living in a time where now more than ever it is easier to start a business. This is fact, not fiction. Don?t take my word for it. Check it out for yourself.

Have you guys read David Hines? Daredevil: Redemption? I met the author and he claims that a lawyer in the US claims he was spot on with the legal stuff in the story? Do you agree?

There are several legal issues in the story, but we?re going to focus on just a couple of the more overt ones. ?There are a few minor spoilers ahead, but nothing too serious. ?For those who haven?t read it, the basic setup of the story is that Murdock is hired to represent a teenager accused of murder in the (fictional) town of Redemption, Alabama. ?Almost all of the action occurs in that small town, ?Daredevil makes only a few appearances, and there are no other superheroes or supervillains. ?The story gives up the broad strokes of capes and superpowers in favor of a well-told human drama. ?It?s a pretty good read, and we recommend picking up a copy.

I. Pro Hac Vice

You may already be asking yourself ?waitaminute: how can Murdock practice law in Alabama. ?Isn?t he from New York?? ?It?s true that the legal profession is regulated by the states, and ordinarily one must be licensed in a state in order to practice there. ?However, in some cases, an attorney may be given special permission by a court to practice out of state. ?This is called appearing?pro hac vice and is typically done for one-off cases or in cases where the attorney has a history of representing the client in their home state and now needs to represent them in a different state.

The way this is described in the comic is quite accurate. ?The local attorney says:

Here?s the situation. The judge has allowed for you to work in the state of Alabama under?pro hac vice. ?He wasn?t too happy, but you have a good rep and, with the press watching this one, he didn?t want anyone calling bias. ?Under state regulation, I sign all the paperwork, I sit beside you in court, but otherwise it?s your case.

That?s pretty much how it works in the real world. ?Local counsel can do more than just sign papers and sit in court, though. ?Sometimes they are active parts of the legal team, and often they are valuable sources of information on local rules, unstated court customs, and the personalities of judges and court staff. ?But fundamentally they are there to make sure that the out-of-state attorneys don?t screw up.

As a side note: what matters is where the attorney is physically located when he or she does the work, not where the client is. ?If Murdock had stayed in New York and simply consulted over the phone or by email, he wouldn?t have needed to be admitted?pro hac vice. ?It wouldn?t matter that he would be advising a client about Alabama law, either. ?Alabama doesn?t care what lawyers in New York do, and New York doesn?t care where the client is, only that the attorney in New York is licensed in New York.

II. The Guilty Client and the Not Guilty Plea

As Murdock often does, he asks his (prospective) client whether he committed the crime. ?The client says, ?Let?s say I am. ?You have to defend me even if I say I killed the kid, right?? ?Murdock responds:

Wrong. ?My professional code of ethics would not allow me to enter a plea of not guilty on your behalf if you tell me you are guilty. ?That information would be protected by the rules of client confidentiality, but I would be obliged to withdraw from representing you.

There are a couple of issues here. ?First the good news: Murdock is correct that the confession would be confidential. ?Now the bad news: there is nothing in the New York or Alabama Rules of Professional Conduct that would prevent an attorney?knowing his or her client is factually guilty of a crime?from entering a plea of not guilty on behalf of the client (although actually it?s the client who states the plea in most cases).

As you probably know, in the United States criminal defendants are presumed innocent until proven guilty. ?The plea of ?not guilty? is necessary in order to force the state to prove its case. ?It?s not a claim of innocence made under oath. ?Someone who pleads not guilty and is proven guilty is not also guilty of perjury, for example. ?As Robert F. Cochran, Jr. explained:

But, of course, courts do not treat the plea inquiry seriously. Courts expect criminal defendants to plead ?not guilty,? irrespective of their guilt. They have avoided what would likely be a constitutional problem by giving defendants what might be called a ?right to lie? at the plea inquiry.

?How Do You Plead, Guilty or Not Guilty??: Does the Plea Inquiry Violate the Defendant?s Right to Silence?, 26 Cardozo L. Rev. 1409, 1433 (2005). ?Cochran describes several rationales for this right to lie, including one by Jack Sammons:

[In a criminal trial] there is only one truth which concerns us, and that is the truth of the government?s case. No other truth matters. We permit the defendant the dishonesty of the not guilty plea, and of the questioning of what he knows to be the truth, and, in doing so, we destroy the dishonesty of the plea and of the questioning. . . . It is not dishonest to lie to others when society removes the expectation of the truth for its own moral purposes . . . . [W]hen [the defendant] lies or [defense counsel lies] for him, to put the government to the test by a plea of not guilty or a questioning of what he knows to be the truth, that is not lying at all because only one truth matters?the truth of the government?s case.

In any case, there are many reasons why a client ?admitting guilt? to his or her attorney is not the same as the client being legally guilty. ?Legal guilt requires that the state prove its case, which doesn?t always happen even when the client is factually guilty. ?And the client could be confused, insane, have a faulty memory, or be lying to his or her attorney in order to protect someone else. ?So there is no reason for the attorney to feel ethically compelled not to allow the client to enter a plea of not guilty even if the client confesses to the attorney.

III. Perjury

Now, what a lawyer?can?t do is knowingly assist a client in committing perjury. ?This usually isn?t a problem in a criminal case, since most criminal defendants don?t take the stand. ?But if they do (and that?s ultimately the client?s choice, not the attorney?s), the attorney can?t ask questions knowing that the client is going to lie. ?There are a few approaches here:

1. The attorney can withdraw. ?This is difficult to do in the middle of a trial, but it?s usually not necessary because of option 2.

2. The attorney can simply invite the client to give an open-ended narrative. ?For example: ?Tell us what you remember from that night.? ?Usually this story will get destroyed on cross-examination, but that?s why criminal defense attorneys usually advise their clients not to take the stand. ?This approach is approved by Model Rule 3.3 and its New York and Alabama equivalents.

3. In some states the attorney can let the client perjure themselves and then inform the court of the perjury. ?Obviously this is not a very satisfying approach for the attorney or the client.

4. Some commentators, such as Monroe Freedman, have argued that the attorney should simply question the client in the usual way, perjury or no. ? Freedman would say that the attorney can?t coach the client on how to lie most persuasively or rehearse the false testimony, but there?s no need to dance around the issue with open-ended narrative questions, either. ?This is a controversial position, to say the least. ?See, e.g, Stephen Gillers, Monroe Freedman?s Solution to the Criminal Defense Lawyer?s Trilemma is Wrong as a Matter of Policy and Constitutional Law, 34 Hofstra L. Rev. 821 (2006). ?It is also universally rejected by ethical codes in the US, but I include it for completeness.

IV. Conclusion

The rest of the book is pretty accurate, and it actually hits a lot of key points regarding withdrawing a confession and cross-examining witnesses. ?The one major error is irrelevant to the plot anyway. ?It?s always nice to see a book that gets the legal details right and also tells a good story.

Every week in?Slate?s?American Horror Story TV club, J. Bryan Lowder will have an IM conversation with a different?AHS fan. This week, he rehashes episode 2.1 with Slate editorial assistant Katy Waldman.

When American Horror Story wrapped up last season, devotees were left at loose ends: Was the spawn of Vivian Harmon and the ghost teenager Tate really the Antichrist? Would the Beetlejuice-like attempts of the Harmon family to scare off prospective homebuyers really keep new families from suffering the same violent fate that they had? Show creator Ryan Murphy has ensured that we?ll never know, because with Season 2, AHS has undergone a complete makeover, featuring a new storyline and cast of characters (though many of the actors, including Lange, return). We?re not even in a haunted Los Angeles house anymore, but instead the Massachusetts asylum of Briarcliff. And what insanity is Sister Jude housing within those antiseptic walls? If last season is any measure, we can expect quite a bit indeed.

J. Bryan Lowder: Good evening Katy, I hope you've recovered from just seeing the painfully wide-eyed visage of Bloody Face! (I'm not sure that I have yet.)

Katy Waldman: It was pretty scary, but the nuns say I'm on the mend.

Lowder: ?Yep, those asylum check-in procedures are a doozy. Speaking of which, I gather this is your first time visiting the macabre environs of American Horror Story, so I'm very interested in your first impressions.

Waldman: Well, I can see where the "horror" part comes in.?I'm not sure I'm feeling the vibe in the same way you do.

Lowder: That's quite all right! But did you find anything redeeming about the show's break-neck ride from aliens to serial-killers to lusty nuns?

Waldman: Sister Jude mentioned the 3 Ps that govern her asylum: productivity, prayer and purification. I'd amend that to perversity, pulp and some synonym for "gross" that begins with P.

Lowder: Ha! Let's talk about what most critics (and the Emmys!) agree is successful in the show: Jessica Lange. Do you love her, or do you love her?

Waldman: Ooh deranged nuns. They are my favorite kind.

Lowder: Mine too! I know you didn't see her as the Southern Gothic belle in the last season, but I'd argue that her performances are the glue that holds this show together, as far as that goes.

Waldman: I can't decide whether she's supposed to be sympathetic (lusting after monsignor...another version of illicit love) or pure evil.

Lowder: I loved her hard-scrabble Boston accent and especially that ambivalence you point out.

Waldman: The accent was great!

Lowder: ?But like you, I definitely feel whiplash about her character so far.

Waldman: What did you make of her line: "I always win against the patriarchal male?? Which she followed by licking her lips like a snake.

Lowder: I liked it, but I thought her use of the word patriarchal sounded out of place. At least to my mind, that would be an academic or countercultural kind of word in the 60s.

Waldman: Me too! The line seemed jarring. It made me wonder whether it was supposed to stand out. I thought maybe the show was clueing us into some of its symbolism. Like, she's some elemental female evil to complement the doctor's male devilry.

Lowder: Hmm, possibly. But I think you're sharp to highlight the strange strand of feminism that runs through this episode. Aside from that comment, we also have her sparing a rather silly young nun from punishment when the girl calls herself dumb. She says: ?Don?t ever call yourself stupid? and lets her go.

Waldman: That's really interesting! But I saw that moment as repression of desire. She said she would flog the young nun if she called herself stupid again. And the prospect seemed to excite her, no?

Lowder: Oh that's interesting; maybe I just wanted to see that as a kind of moment of sisterhood. As in: enough men think we're stupid, so let's not do it to ourselves. You're totally right, of course, that there is a strong S/M streak in Sister Jude. The camera lingers on her wardrobe of implements often enough.

Waldman: Well, I think you're right that she could be a (seriously twisted) feminist heroine. She definitely comes across as forceful and passionate in that red lingerie under her habit.

Lowder: Seriously twisted, like everything else in the show! Including especially that blackmail scene of the lesbian couple. While I generally take AHS with a grain of camp, that moment hit home on an emotional register I wasn't expecting. Did you find it convincing?

Waldman: Yes! Lana's partner was one of the purest characters we saw, I thought. It?s interesting that she teaches science.

Lowder: Right, I loved her line about trying to get evolution on the curriculum. I have a feeling that the battle between science and faith will be a main theme of the season. We also have it embodied in the mad scientist character that is clearly creating some kind of mutant creatures in the bowels of the asylum.

Waldman: Yes; I think we?ll be exploring whether or not they?re mutually exclusive for some time.

Lowder: It?s rich territory, but I found some of the dialogue surrounding those encounters between religion and reason to be trite, but, this being the first episode, I think I?ll give it a pass for the time being.

Waldman: You know what I loved most? Those mysterious creatures lurking outside in the woods. Those moments had such a fairytale feel!

Lowder: That's true, they did! I can't wait to find out what they are. What I am not looking forward to is having to see more of the contemporary story starring Adam Levine.?I just found that whole thing to be inane and unnecessary; the time shifts in the last season were compelling, but this just felt like an excuse for a cameo.

Waldman: Agreed! As if the episode needed to be more complicated?Do you think they just included it so that they could put a young, beautiful couple through the horror paces? Or was there some other meaning we were supposed to pick up?

Lowder: That's a really good question. My feeling right now is the former, because we always have to eroticism before the killer busts in. The scenario just didn't interest me that much, and by the final scene of the girl getting chased by Bloody Face, I was really annoyed by it. Clearly all the mystery is in 1964, not 2012. It all just felt a little tacked on. But looking for meaning in AHS may be a mistake; I really do think it's all about feeling. Will you be extending your stay at Briarcliff?

Waldman: I'm on the fence! I think it might be a sensibility you ease into in the same way that you're shocked at first by the premise of Dexter, but then you get used to the fact that your golden man kills people. It's just that in Dexter, the adjustment is sort of intellectual, and in American Horror Story, it's all about your emotions. Still, you?ve made a pretty convincing case for sticking around.

Lowder: That straitjacket they have you in must be pretty convincing as well!??

(AP) ? Drought, frost and hail have combined to ravage Europe's wine grape harvest, which in key regions this year will be the smallest in half a century, vintners say.

Thierry Coste, an expert with the European Union farmers' union, said Wednesday that France's grape harvest is expected to slump by almost 20 percent compared with last year. Italy's grape crop showed a 7 percent drop ? on top of a decline in 2011.

"Two big producing nations, France and Italy, have not known a harvest so weak in 40 to 50 years," Coste said. "All the major producing nations have been hurt."

France's Champagne and Burgundy regions were hard hit by weather conditions that particularly affected the prevalent Chardonnay grape, used to make the world's most famous sparkling wine and the luxurious whites from those regions.

In places where vintners were already facing a small margin of profit, many could be facing survival problems, said Coste of the Copa-Cogeca union.

"In certain regions, there will be many vintners in big difficulties because of the collapse of the harvest," he said.

The European wine harvest automatically has a global impact since it accounts for some 62 percent of the worldwide wine production.

In Europe, about 2.5 million families live off the wine sector. It makes the dependency on the vagaries of weather a sometimes cruel business.

Drought hit the Mediterranean rim hard this year, Coste said. As a cooperative leader in southern France's Herault region, he should know.

"First and foremost, climate change or not, we see that we have ever more dry spells," he said. Making matters worse is that even winter was dry this time. "It was almost zero (degrees Celsius) in the south."

In the northern wine regions, it was the inverse, with cold and wet weather wreaking havoc. Hail in particular hurt the crops.

"Natural phenomena happened all at the same time to make sure the harvest is so small," Coste said.

French figures show that in Champagne the harvest could decline by 40 percent, with Bourgogne Beaujolais expected to decline 30 percent. Bordeaux would get away lightly with a drop of 10 percent.

Coste said there may be an upside to the bad harvest ? it is not a bitter one when it comes to taste. The quality of the wine produced will be good as it is expected to be more concentrated.

"When it comes to quality, we are looking at a good year," Coste said.

While some price increases were on the cards, Coste hoped they could be contained.

    Rolling Stones to play 4 gigs, Jagger hints at more

    LONDON (Reuters) - The Rolling Stones will perform two concerts in London and two near New York as part of their 50th anniversary celebrations, the band announced on Monday, and lead singer Mick Jagger hinted there could be more gigs to come.

    The British group, one of rock and roll's most successful acts, will play the O2 Arena in the British capital on November 25 and 29 before crossing the Atlantic to perform at the Prudential Center, Newark, on December 13 and 15.

    "Sorry to keep you all hanging around but the waiting is over," guitarist Keith Richards said in a statement, referring to months of rumors and gossip in the music press about an anniversary tour.

    "I've always said the best place for rock and roll is on the stage and the same is true for the Stones," he added. "I'm here with Mick, Charlie and Ronnie and everything is rocking. See you very soon!"

    Richards, fellow guitarist Ronnie Wood, Jagger and drummer Charlie Watts will perform on a stage designed around the band's trademark tongue and lips logo, and organizers have promised a high-tech live experience.

    During an interview on BBC's Radio 2 shortly before the gigs were confirmed, Jagger suggested that the four dates could be a prelude to a longer tour.

    "It's not going to be a long tour, the first bit," he said, when asked how many concerts the Stones planned to perform.

    The band's last world tour was A Bigger Bang, which went on for two years and culminated at the O2 Arena in August 2007. It earned around $558 million, making it the second highest grossing tour in history behind U2's 360 Tour, and demand for tickets to the 2012 concerts is likely to be high.

    "The Rolling Stones are a global phenomenon - and one of the last supergroups still performing with a full line up," said Ed Parkinson, a spokesman for ticketing website Viagogo.

    Viagogo predicted that more than a million people were likely to apply for around 30,000 seats available at the two O2 Arena concerts, meaning the chances of fans being able to see the Stones would be as little as 37:1.

    Tickets to the London shows go on sale on the morning of October 19 and can be purchased on www.rollingstones.com and several other websites. Those for the U.S. concerts will be available from October 26.

    The shows will mark the launch of a new music venture called Virgin Live combining the Virgin Group and Dainty Group, which is already one of the world's biggest live music promoters.

    As part of their 50th anniversary celebrations, the Stones are releasing a new greatest hits album "GRRR!" on November 12/13 and later this week a new documentary charting the group's rise to superstardom will premiere at the London film festival.

    The band behind a string of hits including "(I Can't Get No) Satisfaction", "Honky Tonk Women" and "Angie", started out on July 12, 1962 at the Marquee Club in London's Oxford Street.
